Datenschutzerklärung der Firma Navel GmbH & Co. KG, Kaffeeberg 10/1, 71634 Ludwigsburg, im folgenden Navel.

Nachfolgend informieren wir Sie über Art, Reichweite und Zweck der Erhebung, Speicherung und Verarbeitung personenbezogener Daten auf der mobilen Spieleapplikation „Mimics“. Diese Erklärung können Sie jederzeit in der Applikation unter “Einstellungen/Datenschutz” und unter http://privacy.mimicsgame.com abrufen.

Mit der Fortführung der Installation stimmen Sie der Datenschutzerklärung und der im Folgenden dargelegten Verarbeitung Ihrer im Einzelnen spezifizierten personenbezogenen Daten ausdrücklich zu. Stimmen Sie nicht zu, können Sie unser Produkt nicht nutzen.

1. Begriffsbestimmungen

Für diese Datenschutzerklärung sind:

Personenbezogene Daten alle Informationen, die sich auf eine identifizierte oder identifizierbare natürliche Person beziehen

Verarbeiten ist das Erheben, das Erfassen, die Organisation, das Ordnen, die Speicherung, die Anpassung oder Veränderung, das Auslesen, das Abfragen, die Verwendung, die Offenlegung durch Übermittlung, Verbreitung oder eine andere Form der Bereitstellung, den Abgleich oder die Verknüpfung, die Einschränkung, das Löschen oder die Vernichtung personenbezogener Daten.

2. Wie und wozu werden die Daten erhoben?

Im Rahmen des Downloads werden von der jeweiligen Plattform, also Apple ITunes, Google Play Store oder dem Microsoft Store erhoben, gespeichert und verarbeitet. Auf diese Datenerhebung hat Navel keinen Einfluss.

Es werden außerdem Dienste von Drittanbietern genutzt, um Daten zu erheben, zu speichern und zu verarbeiten. Diese Daten nutzt Navel ausschließlich zu Zwecken der Qualitätssicherung, Nutzung sowie Fortentwicklung der installierten Software und der Vertragsabwicklung.

Schließlich nutzt Navel, sofern Sie eine Softwareversion nutzen, bei der Werbung für Produkte Dritter eingeblendet wird, Dienste Dritter. Diese Drittanbieter blenden Werbung ihrer Kunden in das von Ihnen genutzte Produkt unseres Hauses ein.

3. Welche Daten werden im Rahmen der Qualitätssicherung erhoben?

Zu diesem Zweck setzt Navel eine Software namens Unity Analytics ein. Die Software wurde von der Firma Unity Technologies, 795 Folsom Street, San Francisco, CA 94107 USA entwickelt. Wir verweisen auf folgende Datenschutzrichtlinie: https://unity3d.com/legal/privacy-policy.

Unity Technologies verarbeitet die Daten im Auftrag von Navel im Rahmen der beschriebenen Zwecke zur statistischen Aufbereitung auf Servern in den USA.

Über die Software Unity Analytics werden folgende Daten erhoben, gespeichert und verarbeitet:

IP-Adresse des Nutzers, Daten zum Nutzerverhalten (insbesondere Klicks, Länge einer Sitzung), spielrelevante Daten, wie das Profil-Level, die XP(Erfahrungspunkte), LastLoginTime und schließlich das Gerätemodel und die Firmwareversion des entsprechenden Geräts. Ferner werden Crashreports (Programmzeile, Vorfall, Eckdaten der eingesetzten Computerhardware) an uns übersandt.

Sie erklären sich mit der Verarbeitung Ihre Daten zu den benannten Zwecken sowie der dafür erforderlichen Übermittlung in die USA einverstanden.

4. Welche Daten werden bei der Anmeldung/Registrierung erhoben?

(1) Sie registrieren sich mit Ihrem Facebook Account und haben die Facebook-App installiert: Sobald Sie diese Möglichkeit durch Klicken des Login Buttons auswählen, aktivieren Sie die Facebook-App mit allen von Ihnen vorgegebenen Freigaben. Auf diese Freigaben hat Navel keinen Einfluss. Diese können Sie ggf. Ihren Bedürfnissen entsprechend anpassen und Facebook den Zugang zu bestimmten Daten verweigern. Aufgrund dieser Verbindung stellt Facebook die folgenden Daten zur Verfügung: das öffentliche Profil (sofern bei Facebook hinterlegt, der Vorname, der Nachname; das Profilfoto), Freundeslist. Navel gibt keine Daten an Facebook weiter. Durch die Verknüpfung mit Ihrem Facebook-Profil erklären Sie sich mit der Datenverarbeitung sowie -weitergabe zu den genannten Zwecken ausdrücklich einverstanden. (2) Sie registrieren sich mit Ihrem Facebook Account und haben die Facebook-App NICHT installiert: Sobald Sie diese Möglichkeit durch Klicken des Login Buttons auswählen, aktivieren Sie die Facebook-App mit allen von Ihnen vorgegebenen Freigaben. Auf diese Freigaben hat Navel keinen Einfluss. Diese können Sie ggf. (3) Sie registrieren sich mit Ihrem Google-Account Mit dem Login über Ihren Google-Account erhält Navel zur Authentifizierung Ihrer Person Zugriff auf die Profilinformationen Ihres Google Accounts. Die Profilinformationen die Google in diesem Zusammenhang zur Verfügung stellt beinhalten: Ihren Namen, Ihre E-Mail Adressen, eine individuelle User-ID sowie sofern hinterlegt Ihr Profilfoto. Weiterhin erhält Navel Zugriff auf Ihre Kontakte. Diese Information nutzt Navel um eine Verknüpfung zwischen Ihnen und Ihren Kontakten herzustellen, die ebenfalls die App „Mimics“ nutzen. Navel speichert lediglich Ihre User-ID auf den eigenen Servern, um Sie zu identifizieren. Durch die Verknüpfung mit Ihrem Google Profil erklären Sie sich mit der Datenverarbeitung sowie –weitergabe zu den genannten Zwecken ausdrücklich einverstanden. (4) Sie registrieren sich mit Ihrer E-Mail Adresse: Navel speichert diese E-Mail Adresse auf den eigenen Servern. In diesem Zusammenhang wird ebenfalls Ihre IP-Adresse, die sich im E-Mail Header befindet, gespeichert.

(5) Unabhängig von der Art der Registrierung geben Sie sich in diesem Vorgang einen Nicknamen und können ein eigenes Profilbild Ihrem App-Account zuordnen. Über den Nutzername sind Sie für alle Nutzer der App innerhalb dieser auffindbar. Dort wird ebenfalls Ihr Profilbild angezeigt. Sie erklären sich damit Einverstanden, das Navel für diesen Zweck Ihr Profilbild verwenden, speichern und weitergeben darf.

5. Welche Daten verarbeitet Navel auf den eigenen Servern?

Die folgenden Daten erhebt und/oder speichert Navel auf den eigenen Server um die ordnungsgemäße Nutzung der Applikation zu realisieren sowie für die Vertragsabwicklung.

  • Nutzername + E-Mail Adresse UND/ODER Facebook-User-ID UND/ODER Google User-ID, je nachdem welche Login Varianten Sie nutzen.
  • Geräteinformationen
    • Push-Token, um Neuigkeiten über eine Push-Notifikation zu erhalten
    • Device-ID, Gerätetyp, OS Version
  • Account-Status
    • IP-Adresse Alle Daten werden mit SSL-Verschlüsselung vom jeweiligen Gerät an die Server übermittelt.

6. Werden durch den Anbieter der Download Plattform Daten erhoben?

In jedem Fall werden von den Anbietern der Downloadplattform Daten erhoben. Navel hat auf diese Daten keinen Einfluss und auch keinen Zugriff.

(1) Soweit Sie ein Apple Produkt verwenden, werden Daten werden ebenfalls im Rahmen des Downloads durch die Apple Inc., Infinite Loop, Cupertino, CA 95014, USA erhoben, gespeichert und verarbeitet. Astragon hat auf die durch Apple erhobenen Daten keinen Einfluss. Astragon verweißt auf folgende Datenschutzerklärung von Apple: http://www.apple.com/legal/privacy/de-ww/.

(2) Im Fall der Verwendung eines Android Geräts werden im Rahmen des Downloads Daten durch die Google, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, erhoben, gespeichert und verarbeitet. 7. Wer erhebt welche Daten im Rahmen der Anzeigenwerbung?

(1) Navel setzt zur Abrechnung von Werbung den Service der Firma Google namens Admob ein. Admob ist ein Tochterunternehmen der Firma Google, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Admob erhebt, speichert und verarbeitet Daten. Navel hat auf die Datenerhebung keinen Einfluss. Wir verweisen auf folgende Datenschutzrichtlinie des Unternehmens https://support.google.com/admob/answer/6128543. Sie erklären sich mit der Verarbeitung Ihre Daten zu den benannten Zwecken sowie der dafür erforderlichen Übermittlung in die USA einverstanden.

(2) Navel setzt zur Abrechnung von Werbung den Service Unity-Ads der Firma Unity Technologies, 795 Folsom Street, San Francisco, CA 94107 USA ein. Unity-Ads erhebt, speichert und verarbeitet Daten. 8. Kann ich die Daten löschen lassen und/oder erfahren, welche Daten über mich gespeichert werden?

Ja. Die hier erteilte Einwilligung erfolgt freiwillig und kann mit Wirkung für die Zukunft widerrufen werden. Der Widerruf kann, um sicherzustellen, dass dieser nur vom Profilinhaber getätigt wird, über eine private Facebook Nachricht an https://www.facebook.com/NavelGames/ erfolgen. Gleichzeitig wird damit das Profil des Nutzers unwiderruflich gelöscht. FAQ

  1.  Wozu braucht ihr meinen Facebook-Zugriff?
    Für das Online-Spiel müssen wir dich eindeutig identifizieren. Zusätzlich möchten wir dass du mit deinen Facebook-Freunden spielen kannst. Mimics postet niemals selbstständig etwas, schreibt keine Nachrichten und greift auf keinerlei weiteren privaten Inhalte von dir zu.
  2. Wie lange werden meine Online-Bilder gespeichert?
    Dein Online-Bild wird je nach aktueller Nutzerzahl ein oder mehrmals geraten. Sobald genügend neue Bilder gemacht wurden, werden die alten Bilder automatisch gelöscht. Schätzungsweise werden sie nie länger als eine Woche online sein.
  3. Wo speichert ihr mein Online-Bild?
    Auf unserem eigenen dafür entwickelten Server. Zugriff haben nur zwei Personen und dies auch nur um den Server zu warten. Die Übertragung wird verschlüsselt.
  4. Ich möchte meinen Account löschen.

Nutzungsbedingungen „Mimics“
Navel GmbH & Co. KG

  1. Geltungsbereich
    1. Diese Allgemeinen Nutzungsbedingungen (nachfolgend als „Nutzungsbedingungen“ bezeichnet) gelten für alle Verträge zwischen der Navel GmbH & Co. KG, Kaffeeberg 10/1, 71634 Ludwigsburg, Germany (nachfolgend als „Navel“ bezeichnet) und den Nutzern des Spiels „Mimics“ (nachfolgend als „Spieler“ bezeichnet).
    2. Abweichende, zusätzliche oder diesen Nutzungsbedingungen widersprechende Allgemeine Geschäftsbedingungen des Spielers akzeptiert Navel nicht, so dass diese nicht in den Vertrag einbezogen werden. Dies gilt nicht, wenn Navel der Einbeziehung der Allgemeinen Geschäftsbedingungen des Spielers zugestimmt hat.
  2. Vertragsgegenstand
    1. Mimics ist ein kostenlos herunterladbares Online-Spiel, das in Verbindung mit einem Profil bei dem durch die Facebook Inc. betriebenen sozialen Netzwerk „Facebook“ gespielt werden kann.
    2. Für die Nutzung von Mimics benötigt der Spieler ein internetfähiges mobiles Endgerät, das über eine Kamera verfügt.
  3. Vertragsschluss über die kostenfreie Spielenutzung
    1. Um Mimics spielen zu können, muss sich der Spieler für einen Account registrieren.
    2. Der Spieler wählt einen Spielernamen und betätigt die Schalfläche mit der Beschriftung „registrieren“.
    3. Der Spieler gelangt zu einem Registrierungsformular, das er nach Betätigung der Schaltfläche mit der Beschriftung „Konto erstellen“ ausfüllen kann. Durch Eintragen der im Registrierungsformular abgefragten Daten und anschließender Betätigung der Schaltfläche mit der Beschriftung „registrieren“ gibt der Spieler ein verbindliches Angebot über die Nutzung von Mimics ab. Vor Betätigung der Schaltfläche „registrieren“ hat der Spieler die Möglichkeit seine Angaben zu korrigieren, zu löschen oder den Registrierungsvorgang auch durch Schließen der App abzubrechen.
    4. Navel nimmt das Angebot des Spielers durch Bereitstellen des Spieleraccounts verbindlich an.
    5. Mit dem Bereitstellen des Spieleraccounts durch Navel kommt ein verbindlicher Vertrag zwischen Navel und dem Spieler über die kostenlose Nutzung des Spiels Mimics zustande.
  4. Vertragsschluss über die kostenpflichtige Spielenutzung
    1. Der Spieler hat auch die Möglichkeit, sich für einen kostenpflichtigen Premium-Account für Mimics zu registrieren.
    2. Um sich für einen kostenpflichtigen Premium-Account zu registrieren, betätigt der Spieler in seinem Kundenkonto, die Schaltfläche, auf der das Symbol „Einkaufswagen“ abgebildet ist.
    3. Der Spieler betätigt die Schaltfläche mit der Beschriftung „Hol Dir Premium!“.
    4. Der Spieler wird in das Warenkorbsystem seines jeweiligen App Stores weitergeleite. Der Vertragsschluss erfolgt zwischen dem Spieler und dem jeweiligen Betreiber des App Stores. Navel hat keine Möglichkeit, den Vertragsschluss sowie Preise und Zahlungsbedingungen des jeweiligen App Store Betreibers zu beeinflussen und verweist insoweit auf die Allgemeinen Geschäftsbedingungen des App Store Betreibers.
  5. Veröffentlichung von Fotos
    1. Bestandteil des Spiels ist das Hochladen von Fotos, die durch dritte Spieler im Spielverlauf eingesehen werden können.
    2. Navel kontrolliert die veröffentlichten Fotos vor der Veröffentlichung nicht. Im Falle eines Hinweises auf die Rechtswidrigkeit eines Beitrages behält sich Navel ausdrücklich die unverzügliche Löschung einzelner Fotos vor.
    3. Der Spieler verpflichtet sich gegenüber Navel keine Fotos zu veröffentlichen, die gegen die Gesetze der Bundesrepublik Deutschland oder die Rechte Dritter verstoßen.
    4. Der Spieler stellt Navel von allen Rechten Dritter frei, die diese aufgrund der Veröffentlichung von Fotos über Mimics gegen Navel geltend machen. Vorbehaltlich der Zustimmung des Spielers wird Navel keine Anerkenntnisse oder andere die geltend gemachten Ansprüche des Dritten begründenden rechtsgeschäftlichen Erklärungen abgeben.
    5. Die in Ziffer 5.D dieser Nutzungsbedingungen bezeichnete Freistellungsverpflichtung entfällt, wenn die die Ansprüche des Dritten begründenden Umstände nachweisbar auf einem grob fahrlässigen oder vorsätzlichen Fehlverhalten von Navel beruhen.
    6. Navel verpflichtet sich, den Spieler unverzüglich von der Erhebung gegen Navel erhobener Klagen oder der Geltendmachung von Ansprüchen in Kenntnis zu setzen und ihm die Möglichkeit der Übernahme der Rechtsverteidigung zu geben.
  6. Gewährleistung
    1. Die verschuldensunabhängige Haftung auf Schadensersatz für anfängliche Mängel gemäß § 536a Abs. 1 BGB ist ausgeschlossen.
    2. Vorbehaltlich Ziffer 6.A dieser Nutzungsbedingungen gelten die gesetzlichen Gewährleistungsrechte.
  7. Kündigung
    1. Der Spieler hat jederzeit die Möglichkeit, seinen Spieleraccount löschen zu lassen.
    2. Dazu versendet der Spieler eine Löschungsanfrage an die E-Mail-Adresse contact [] navel .cc oder die im Impressum des Spiels angegebenen Kontaktdaten. Navel wird den Spieleraccount unverzüglich nach Zugang der Löschungsanfrage löschen.
    3. Vorbehaltlich einer Löschungsanfrage des Spielers ist Navel nicht berechtigt, den Spieleraccount des Spielers zu löschen.
    4. Das Recht zur außerordentlichen fristlosen Kündigung beider Parteien bleibt unberührt. Ein außerordentliches Kündigungsrecht besteht für Navel insbesondere dann, wenn der Spieler gegen wesentliche Pflichten aus dem Vertrag, insbesondere Ziffer 5.C dieser Nutzungsbedingungen, verstößt.
    5. Jede Kündigung bedarf der Textform.
  8. Haftung
    1. Navel haftet in allen Fällen vertraglicher und außervertraglicher Haftung bei Vorsatz und grober Fahrlässigkeit nach Maßgabe der gesetzlichen Bestimmungen.
    2. In sonstigen Fällen haftet Navel – soweit in Ziffer 8.C dieser Nutzungsbedingungen nicht abweichend geregelt – nur bei Verletzung einer Vertragspflicht, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung der Spieler daher regelmäßig vertrauen darf (so genannte Kardinalpflicht). In allen übrigen Fällen ist die Haftung von Navel vorbehaltlich der Regelung in Ziffer 8.C dieser Nutzungsbedingungen ausgeschlossen.
    3. Soweit Navel gemäß Ziffer 8.A dieser Nutzungsbedingungen dem Grunde nach haftet, ist diese Haftung auf Schäden begrenzt, die Navel bei Vertragsschluss als mögliche Folge einer Vertragsverletzung vorausgesehen hat oder bei Anwendung verkehrsüblicher Sorgfalt hätte voraussehen müssen. Mittelbare Schäden und Folgeschäden, die Folge von Mängeln der Leistung durch Navel sind, sind außerdem nur ersatzfähig, soweit solche Schäden bei bestimmungsgemäßer Verwendung der Leistung typischerweise zu erwarten sind.
    4. Die Haftung von Navel für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit und nach dem Produkthaftungsgesetz bleibt von den vorstehenden Haftungsbeschränkungen und -ausschlüssen unberührt.
  9. Aufrechnung, Zurückbehaltungsrechte und Abtretung
    1. Der Spieler ist zur Aufrechnung nur gegen rechtskräftig festgestellte oder unbestrittene Forderungen gegen Navel berechtigt. Gleiches gilt für die Geltendmachung von Zurückbehaltungsrechten.
    2. Die Abtretung von Ansprüchen gegen Navel an Dritte ist nur mit schriftlicher Zustimmung von Navel möglich. Dies gilt insbesondere auch für eine Übertragung des Spieleraccounts auf Dritte.
  10. Textform
    1. Ergänzungen und Abänderungen der getroffenen Vereinbarungen zwischen Navel und dem Spieler einschließlich dieser Nutzungsbedingungen bedürfen zu ihrer Wirksamkeit der Textform.
    2. Mit Ausnahme von Geschäftsführern oder Prokuristen sind die Mitarbeiter von Navel nicht berechtigt, hiervon abweichende mündliche Abreden zu treffen.
  11. Anzuwendendes Recht und Gerichtsstand
    1. Es gilt deutsches Recht. Bei Verbrauchern gilt diese Rechtswahl nur, soweit hierdurch der durch zwingende Bestimmungen des Rechts des Staates des gewöhnlichen Aufenthaltes des Verbrauchers gewährte Schutz nicht entzogen wird (Günstigkeitsprinzip).
    2. Erfüllungsort für alle Leistungen aus den mit Navel bestehenden Geschäftsbeziehungen sowie Gerichtsstand ist der Sitz von Navel, soweit der Nutzer nicht Verbraucher, sondern Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen ist. Dasselbe gilt, wenn der Spieler keinen allgemeinen Gerichtsstand in Deutschland oder der EU hat oder der Wohnsitz oder gewöhnliche Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt ist. Die Befugnis, auch das Gericht an einem anderen gesetzlichen Gerichtsstand anzurufen, bleibt hiervon unberührt.
    3. Die Bestimmungen des UN-Kaufrechts finden ausdrücklich keine Anwendung.

Personal Data constitutes all information, which refers to an identified or identifiable natural person

In connection with downloading process, data are collected, saved and processed by the respective platform, that is, Apple ITunes, Google Play Store or the Microsoft Store. Navel has no influence on this form of data collection.
Furthermore, services of third-party providers are used to collect, save and process data. Naval only uses these data for the purposes of quality assurance, use as well as the further development of installed software and executing contracts.
Finally, Navel uses third-party services to the extent you use a software version that displays advertising for third-party products. These third-party providers place advertising from their customers in our product, which you use.

3. Which data are collected in connection with quality assurance?

Unity Technologies processes data for the order of Navel in connection with the described purposes for statistical processing on the servers in the USA.
The following data are collected, saved and processed through Software Unity Analytics:

4. Which data are collected when logging on/registering?

(1) You register with your Facebook account and have installed the Facebook app: As soon as you select this possibility by clicking the login button, you activate the Facebook app with all the approvals you have defined. Furthermore, Navel gains access to your contacts. Navel uses this information to link you and your contacts, who also use the “Mimics” app. Navel only saves your user ID on its own servers in order to identify you. By linking the app to your Google profile, you are expressly agreeing to the processing as well as the dissemination of data for the aforementioned purposes.

(4) You register with your e-mail address: Navel saves this e-mail address on its own servers. Your IP address, which is also located in the e-mail header, is also saved in this context.

(5) Regardless of the type of registration, you give yourself a nickname in this step and can assign your own profile photo to your app account. All app users can find you in the app with your user name. Your profile photo will be shown there. You consent to Navel using, saving and passing on your profile photo for this purpose.

5. Which data does Navel process on its own servers?

    We need to uniquely identify you. Moreover we want you to be able to play with your Facebook friends. Mimics will never post without your permission on its own, nor do we access any additional privat content of you.
  2. How long are my online pics saved?
    Your online pic will, depending on how many party people are playing right now, be guessed one or more times. As soon as enough new pics are uploaded, the old one will automatically be deleted. This will roughly be something between one to seven days.
  3. Where do you save my online pic?
    We save the online pics on our specially for this developed server. Only two people have access – just for maintenance. All communication is encrypted.
  4. I want to delete my account.
    Just drop us a line with your connected Facebook account here or write us an email.
  5. Can I support you?
    Absolutely. All the time! Drop us a line anytime you want on our social channels!

 

General business terms

1. Domain of applicability

1.1 These General Terms of Use (hereinafter referred to as “Terms of Use”) apply to all contracts between Navel GmbH & Co. KG, Kaffeeberg 10/1, 71634 Ludwigsburg, Germany (hereinafter referred to as “Navel”) and the users of the “Mimics” game (hereinafter referred to as the “Players”).

1.2 Navel shall not accept divergent, additional general business terms of the Player, or those which conflict with these Terms of Use; they shall therefore not be included in this contract. This shall not apply if Navel has consented to the inclusion of the General Business Terms of the Player.

2. Subject matter of the Contract

2.1 Mimics is an online game available for download free of charge, which can be played on the basis of a profile on the social network “Facebook” operated by Facebook Inc.

2.2 To use Mimics, the player must have an Internet-ready mobile device with a camera.

3. Conclusion of a contract for playing the free game

3.1 In order to be able to play Mimics, the Player must register an account.

3.2 The Player shall select a player name and touch the “Register” button.

3.3 The Player shall access a registration form, which he or she can fill out by touching the “Open an account” button. By entering the data requested in the registration form and subsequently touching the “Register” button, the Player is submitted a binding offer to use Mimics. Before touching the “Register” button, the player may make any corrections to the information he or she has provided or delete his or her information or abort the registration process by closing the app.

3.4 Navel shall accept the offer of the Player with binding effect by activating the player account.

3.5 In activating the player account on the part of Navel, a binding contract shall be established between Navel and the Player for the free use of the Mimics game.

4. Conclusion of a contract for playing the paid game

4.1 The Player also has the possibility of registering for a paid premium Mimics account.

4.2 In order to register for a paid premium account, the Player must touch the button with the “shopping basket” symbol in his or her customer account.

4.3 The Player pushes the “Go Premium!” button.

4.4 The Player shall be directed to the shopping basket system of the respective app store. The contract shall be concluded between the player and the respective operator of the app store. Navel has no possibility of influencing the conclusion of the contract or the payment terms for the respective app store of the operator and in this respect, refers to the General Business Terms of the app store operator.

5. Publication of photos

5.1. Part of the game involves uploading photos, which can be viewed by third-party players during the course of the game.

5.2. Navel does not check the photos before they are published. If a notice advising of the illegality of a contribution is received, Navel shall expressly reserve the right to immediately delete individual photos.

5.3. The Player undertakes vis-à-vis Navel to not publish photos, which breach the laws of the Federal Republic of Germany or the rights of third parties.

5.4. The Player shall release Navel from all third-party rights, which are asserted vis-à-vis Navel on the basis of the publication of photos via Mimics. Unless the Player has consented to this, Navel shall not issue any acknowledgements or other legally binding declarations that establish the asserted claims of the third party.

5.5. The obligation to indemnify described under 5.4 of these Terms of Use shall be ruled out if the circumstances establishing the claims of the third party are demonstrably based on grossly negligent or intentional misconduct.

5.6. Navel undertakes to immediately notify the Player of the filing of complaints against Navel or the assertion of claims and to give it the possibility of taking over legal defence.

6. Warranty

6.1 Liability without fault for compensation of incipient defects in accordance with Section 536a (1) German Civil Code (BGB) is excluded.

6.2 Subject to 6.1 of these Terms of Use, the statutory warranty rights shall apply.

7. Termination

7.1 The Player may have his or her player account deleted at any time.

7.2 To do so, the Player shall send a request to deletion his or her account to the e-mail contact [@] navel.cc or it shall direct this request to the contact data provided in the game credits. Navel will delete the player account immediately upon receipt of the request to delete the Player’s account.

7.3 Subject to a request for deletion from the Player, Navel shall not be entitled to delete the account of the Player.

7.4 The right of both parties to extraordinary termination without notice shall remain unaffected. Navel shall, in particular, have an extraordinary right to terminate if the Player breaches the cardinal duties of the contract, in particular 5.3 of these Terms of Use.

7.5 Every termination must occur in written form.

8. Liability

8.1 Navel shall be liable in all cases of contractual and extra-contractual liability in the event of intent or gross negligence as prescribed by statutory provisions.

8.2 In other cases, Navel – to the extent not otherwise provided for in 8.3 of these Terms of Use – shall only be liable if a contractual duty is breached whose fulfilment makes the proper execution of the contract possible in the first place and whose fulfilment the Player may therefore regularly depend on (a so-called cardinal duty). In other cases, the liability of Navel is subject to the provision in 8.3 of these terms of use.

8.3 To the extent Navel is liable in accordance with 8.1 of these terms of use, this liability shall be limited to damages, which Navel has foreseen at the time the contract was concluded as a possible consequence of a breach of the contract or should have foreseen had it exercised the due diligence and care. Indirect damages and consequential damages, which are the result of defects in the performance of Navel, are furthermore only eligible for compensation to the extent such damages can be typically expected with proper use of the service.

8.4 Liability on the part of Navel for damages resulting from injury to life, limb or health and in accordance with the German Product Liability Act, shall remain unaffected by the above limitations and exclusions of liability.

9. Set-off, rights of retention and assignment

9.1 The Player shall only entitled to set off against legally established or undisputed claims vis-à-vis Navel. The same applies to the assertion of rights of retention.

9.2 The assignment of claims vis-à-vis Navel to third parties is only possible with the written consent of Navel. This particularly applies to the transfer of the player account to third parties.

10. Text form

10.1 Supplements and amendments to the agreements made between Navel and the Player including these Terms of Use must be made in writing in order to be valid.

10.2 With the exception of managing directors or authorised signatories, the employees of Navel are not entitled to make divergent verbal agreements.

11. Applicable law and jurisdiction

11.1 German law shall apply. The foregoing provisions regarding the governing law apply to consumers only to the extent that the protection granted by mandatory provisions of the country in which the consumer maintains its customary residence is not withdrawn (favourability principle).

11.2 The place of performance for all services in connection with the business relationships in place with Navel as well as the jurisdiction shall be the headquarters of Navel if the user is not a consumer, but a merchant, legal entity under public law or special fund under public law. The same applies if the Player does not have any qualification jurisdiction in Germany or the EU or its place of residence or a customary residence is not known at the time the action is brought. The authority to also appeal to another court of jurisdiction shall remain unaffected by this.

11.3 The provisions of the United Nations Convention on Contracts for the International Sale of Goods shall expressly not apply.
